1 This is an appeal by Paul Heartsill and Claud C. Arnold, plaintiffs in error, defendants below. They were charged by information in the District Court of Carter County, Oklahoma, with the crime of conspiracy to defraud the State of Oklahoma. 21 O.S. 1951 ? 424 [21-424]. They were tried to a jury, convicted, and the punishment for each fixed at one year in the state penitentiary and a fine of $5,000. Judgment and sentence were entered accordingly, from which this appeal has been perfected.
